15. 4. 2019
Based on a request received on April 15, 2019 for the provision of information pursuant to Act No. 106/1999 Coll., CAI provided the applicant with the following information, structured according to the questions asked by the applicant.
The scope of accreditation granted to the Ministry of the Interior of the Czech Republic for its laboratory No. 1494 "Criminal Institute Prague of the Police of the Czech Republic (KÚP PČR)" is published on the CAI website www.cai.cz in the database of accreditation bodies for conformity assessment. From this database it can be verified that the valid accreditation granted to the Ministry of the Interior of the Czech Republic for its accredited laboratory No. 1494 is documented by the accreditation certificate No. 425/2017 dated 18 July 2017. The conformity assessment activity "Determination of the order of manual recording and electrographic printing according to the distribution of toner particles" indicated by you is not included in the scope of this accreditation. As in the previous information provided to you in 2017, I would like to inform you that the Ministry of the Interior of the Czech Republic and its accredited laboratory No. 1494 "Criminal Institute Prague of the Police of the Czech Republic (KÚP PČR)" have not been granted accreditation covering the activity "Determination of the order of manual recording and electrographic printing according to the distribution of toner particles" in the past either. As for the information about the activity "under another name", this requirement is not specific enough to provide unambiguous information. However, it can be stated that the scope of accreditation of the laboratory in question No. 1494 has never included an activity that would contain the word "order" or "toner" in its name.
28. 2. 2019
Based on a request received on February 26, 2019 for the provision of information pursuant to Act No. 106/1999 Coll., CAI provided the applicant with the following information, structured according to the questions asked by the applicant.
CAI is a national accreditation body within the meaning of Section 15 of Act No. 22/1997 Coll., on technical requirements for products and on amending and supplementing certain acts, as amended, and Regulation (EC) No. 765/2008 of the European Parliament and of the Council of 9 July 2008 setting out the requirements for accreditation and market surveillance relating to the placing of products on the market and repealing Regulation (EEC) No. 339/93. As such, CAI accredits conformity assessment bodies within the meaning of these legal regulations. As part of accreditation, CAI checks whether the applicant for accreditation / accredited conformity assessment body meets the requirements for carrying out specific conformity assessment activities set out in harmonised standards or other documents applicable to the field of conformity assessment (so-called "accreditation requirements"). CAI does not accredit fields, methods, procedures, expert opinions or other documents.
Regarding your individual questions, CAI states the following:
a) Who is the guarantor of the accredited field of calligraphy - the branch of handwriting research?
CAI has not accredited the field of handwriting analysis, it is not an "accredited field". The accredited laboratory No. 1494 you mentioned is a testing laboratory, therefore it falls under the competence of the Department of Testing and Calibration Laboratories. The relevant guarantor for the development of accreditation is the guarantor for the field of technical testing laboratories.
b) Have you accredited the test method SOP No. GRA-02 and handwriting examination?
CAI has not accredited any test method, neither the "SOP No. GRA-02" method nor the "handwriting examination" method. CAI has granted accreditation to the conformity assessment body of the Czech Ministry of the Interior for its testing laboratory No. 1494, the Criminalistic Institute Prague of the Police of the Czech Republic (KÚP PČR). The valid accreditation is granted within the scope of forensic testing defined in the annex to the accreditation certificate No. 425/2017 of 18 July 2017 and its scope, which is published on the CAI website www.cai.cz , includes, among other things, tests in the field of handwriting examination. For the sake of completeness, I would like to inform you that the test procedures/methods listed in the annex to the accreditation certificate are the property of the accredited conformity assessment body, CAI has not accredited them, nor has it validated them in any way through accreditation, and does not have their text available.
c) According to what scientifically demonstrable literature have you accredited this method? If possible, please provide documentation of literature related to epigraphy.
CAI has not accredited any test method, it has not “accredited” any test method.
d) How often is it necessary to recalibrate the ruler and protractor according to accreditation - the measuring instruments used according to accreditation?
Accreditation is evidence of the professional competence of a conformity assessment body to carry out conformity assessment activities that are listed in the scope of the granted accreditation, in accordance with the accreditation requirements (see above for this term). Accreditation does not establish either the obligation or the calibration interval of measuring instruments. The obligation to calibrate measuring instruments, if they have an impact on the test result, is established by the relevant harmonised standard. However, the specific calibration period is determined by the laboratory based on consideration of the impact on the results, handling of measuring instruments, their stability, etc.
e) Where can I find the rules for the accredited methodology for processing forensic expert audit reports?
CAI did not accredit any methodology, including the "methodology for processing forensic audit reports". Accreditation was granted to the conformity assessment entity in relation to its testing laboratory according to the harmonized technical standard ČSN EN ISO/IEC 17025:2005 Conformity assessment - General requirements for the competence of testing and calibration laboratories.
f) Who is the lead expert assessor of the accredited handwriting examination method? Please provide their name in case of a summons to a court hearing and an explanation of the procedure for accrediting this method by your institute.
The CAI has not accredited any method, not even the "handwriting examination" method.
g) By what accredited method did you arrive at the various degrees of probability to certainty? What formula for a probable conclusion was used? Please provide supporting scientific and research literature.
CAI has not accredited any methods. CAI is an accreditation body that accredits conformity assessment bodies. CAI itself does not carry out conformity assessment activities, does not apply test procedures or methods and therefore does not reach degrees of probability to certainty and does not establish probable conclusions.
h) What is the content structure of an accredited forensic expert review report?
CAI has not accredited any forensic audit report. The only thing that can be stated on this issue is that the output documents of Testing laboratories accredited according to the accreditation standard ČSN EN ISO/IEC 17025:2005 Conformity assessment - General requirements for the competence of testing and calibration laboratories must meet the requirements set out in this standard, or other documents valid for the area of conformity assessment (e.g. ILAC G19:08/2014 Modules in the forensic process).
i) Is it possible to work with different material that the previous expert did not have available to you in the forensic expert review report accredited by you?
CAI has not accredited any forensic audit report.
