Information provided pursuant to Act No. 106/1999 Coll.

24. 11. 2017

Based on the request dated 21. 11. 2017, delivered to CAI on 22. 11. 2017, for the provision of information pursuant to Act No. 106/1999 Coll., requesting answers to 6 questions in relation to the accreditation of experts and the field of handwriting analysis, CAI provided the following answers to the questions posed, thereby fully complying with the applicant's request for information. The name of the expert provided by the applicant was removed from the published text of the response for reasons of personal data protection.

1) Is the expert (name of the expert) accredited by your institute? If so, please tell me what accreditation she holds.

(name of expert) according to the CAI records is not and has not been an accredited conformity assessment body within the meaning of Act No. 22/1997 Coll., on technical requirements for products, as amended (hereinafter referred to as the “ZTPV”). The answer is therefore no, (name of expert) does not have accreditation granted by the CAI.

2) Is it possible for an expert who does not work for an entity accredited by you to claim that he or she is working on the basis of your accreditation?

The right to act as an accredited conformity assessment body is granted only to those conformity assessment bodies that have been granted accreditation by the CAI. An overview of accredited conformity assessment bodies is publicly available on the CAI website (www.cai.cz). Unauthorized acting as an accredited conformity assessment body without granted accreditation or outside the scope of granted accreditation is an administrative offence within the meaning of Section 19a, paragraph 1, letter e) of the ZTPV, the examination of which is the responsibility of the Czech Office for Standards, Metrology and Testing (ÚNMZ).

3) It is true that you accredited according to the above expert:

Quote: "standards that are defined by the Czech Accreditation Institute, and which are also used by experts, including the Institute of Criminology"?

The claim that CAI defines standards is not true. CAI is an accreditation body within the meaning of Section 15 of the ZTPV, whose competence includes the accreditation of conformity assessment bodies pursuant to Sections 16 and 17 of the same Act. CAI does not define standards. If the term “standards” refers to Czech technical standards, then these fall within the competence of the Czech Office for Standards, Metrology and Testing (ÚNMZ) in accordance with Section 4 of the ZTPV.

4) Have you accredited the field of scriptology, according to the expert (name of the expert), yes?

No. CAI exclusively accredits conformity assessment bodies if they demonstrate that they meet the requirements for carrying out a specific conformity assessment activity, which are set out in harmonised standards or other documents applicable to the given area of conformity assessment (so-called accreditation requirements). CAI does not accredit fields, procedures, methods, methodologies, etc.

5) According to the above-mentioned expert, you accredited the field of handwriting analysis based on the 1984 methodology "Handwriting Expertise". Is this statement true?

No. As stated in the previous point, CAI exclusively accredits conformity assessment bodies, provided that they demonstrate that they meet the accreditation requirements. CAI does not accredit disciplines, procedures, methods, methodologies, etc. It is not true that CAI has accredited the discipline of scriptology.

6) If you have accredited the field of calligraphy, I hereby request the name of a specific assessor, for the purposes of the court hearing and his/her summons as a witness to the accreditation of the field of calligraphy.

CAI does not accredit fields, procedures, methods, methodologies, etc. It is not true that CAI has accredited the field of scriptology.
